Arc Light Entertainment, Inc. (ALE) warrants its installation
against defects for the period of one year to include:
- Workmanship
- Physical installation
- Wiring and connections
- Rigging parts and hardware
- mall parts
- Custom parts and assemblies provided by ALE
The warranty period will commence at the time of system sign-off or at
first significant use of the system, whichever occurs first.
First significant use of the system is defined as the client’s first use
of the system for its intended purpose. ALE reserves the right to determine
first significant use of the system.
ALE will provide labor and parts necessary to support manufacturer’s warranties
for a period of 90 days from the date of system sign-off or first significant use.
During this period, ALE will repair or replace defective equipment in conjunction
with the warranties and policies set forth by the manufacturer’s terms and
conditions at no charge to the client. ALE will work diligently with the client
and manufacturer(s) to minimize system interruption due to equipment failures;
however, ALE will not be held responsible for consequences resulting from down time.
Following this 90-day period, ALE will provide labor and parts necessary to support
manufacturer’s warranties at prevailing rates. Manufacturer warranties remain in
effect for the duration of the individual warranty periods. Service labor rates are
outlined in the "Technical Services Terms and Conditions" document. Parts are not
included in these labor rates and will be invoiced as separate line items.
This warranty is in lieu of any other warranties, express or implied, including any
implied warranty of merchantability, fitness for a particular purpose or otherwise,
and of any other obligations or liability on ALE’s part. Under no circumstances
shall ALE be liable to client or any third party for any loss, damage, injury or
expense including but not limited to special, incidental, indirect or consequential
damages arising in connection with the use, or inability to use, the goods and services
provided, whether or not ALE has been advised of the possibility of such potential
loses, injuries, expenses or damages.
Extended Service and Preventive Maintenance: A Service and Preventive Maintenance
Agreement (SPMA) may be purchased from ALE that provides routine maintenance
(cleaning, adjustments, etc.) and also a 10% discount off standard labor rates.
SPMA pricing is based on the size, complexity, location, and response time required
by the client. The SPMA covers a period of one year from the date of agreement and
commences upon receipt of payment.
Warranty Exceptions and Exclusions: ALE’s terms of warranty apply provided failure
is solely the result of installation or manufacturer defect. Equipment or system
failure resulting from the following is NOT covered under this warranty and all time
and materials required for repair will be billed at prevailing rates as outlined in
the "Technical Services Terms and Conditions" document.
- Misuse
- Improper operation
- Repair or adjustment by non-ALE personnel
- Connection or use with equipment or software not supplied by ALE
- Accidents, trauma or Act of God
